These terms apply when you register a cat or a dog on the national pet register operated by Sandbox Corp Limited trading as Pet Care Essentials. Please read them carefully. They tell you who we are, what registration does, what it does not do, what you must do, what it costs, and how you and we may bring the arrangement to an end.

Note. Registration is a separate product from PCE Membership. Registration is a one off payment and it is the product that meets the legal requirement. PCE Membership is a monthly subscription that adds optional services. You do not need a membership in order to register a microchip or to comply with the law. Membership is governed by the Membership Terms and Cancellation.

2. WHAT REGISTRATION IS AND WHAT IT DOES

2.1

We operate a pet microchip database. We hold ourselves out as meeting the conditions imposed on database operators by regulation 7 of the Microchipping of Cats and Dogs (England) Regulations 2023.

2.2

When you register an Animal with us we record the details required by regulation 6 of those Regulations. Those details include your full name and address, your contact telephone number where you have one, the Microchip number, the date of implantation, and the description of the Animal.

2.3

Registration on a database operated by an operator meeting the conditions in regulation 7 is one of the two things the Regulations require. The other is the implantation of a compliant Microchip. A Microchip that has been implanted but not registered, or that is registered to details that are no longer accurate, does not satisfy the requirement.

2.4

We make the Registration available to Authorised Users in the circumstances set out in the Regulations, and we operate a telephone line and an online enquiry system through which requests may be made at any time.

2.5

Registration lasts for the life of the Animal. There is no renewal fee and no annual charge.

3. WHAT REGISTRATION DOES NOT DO

3.1

Registration does not prove ownership of the Animal. The Register records the Keeper. A dispute about who owns an animal is a matter between the people concerned and, if it cannot be resolved, for the courts. We do not adjudicate ownership disputes and we will not take sides in one.

3.2

Registration does not guarantee that a lost Animal will be found or returned. It improves the prospect of reunification. It does not assure it.

3.3

Registration does not discharge any other legal duty you owe. In particular, a dog in a public place must still wear a collar with the keeper's name and address on it under the Control of Dogs Order 1992. A Microchip does not remove that requirement.

3.4

Registration is not insurance, it is not veterinary cover, and it does not include any PCE Membership service.

4. YOUR OBLIGATIONS

4.1

You must give us information that is accurate and complete, and you must be entitled to give it to us.

4.2

You must keep the recorded details up to date. This is a continuing statutory duty that falls on you, not on us. You must tell us promptly if you move, if your telephone number or email address changes, or if the Animal dies.

4.3

If the Animal passes to a new keeper, the Regulations require the new keeper to be recorded. Under the Regulations a transfer of a cat or dog is not treated as complete until the new keeper's details have been recorded. We do not charge for recording a transfer of keepership.

4.4

You must not record details for an animal you do not keep, and you must not record details you know to be false.

4.5

If you register an Animal as a breeder, you must also comply with the Animal Welfare (Licensing of Activities Involving Animals) (England) Regulations 2018, including the requirement to record your local authority licence number where you hold one.

5. FEES AND PAYMENT

5.1

The Registration Fee is £25 including VAT, payable once, for each Animal registered.

5.2

The Registration Fee covers the Registration for the life of the Animal, all subsequent changes to your recorded details, any transfer of keepership, and access to the reunification service.

5.3

Payment is taken at the point of Registration. We accept the payment methods shown at checkout. Title to the Registration record does not pass to you. What you acquire is the service described in these terms.

5.4

Where a Microchip has been supplied to you as part of a pack purchased from us, or supplied through a veterinary practice, breeder or rescue organisation holding a PCE trade account, the Registration Fee may already have been paid on your behalf. The checkout will tell you if no further payment is due.

5.5

We may change the Registration Fee at any time. A change does not affect a Registration already completed and paid for.

6. YOUR RIGHT TO CANCEL

6.1

If you are a consumer you have a right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel a contract made at a distance within 14 days of entering into it, without giving a reason.

6.2

Registration is a service that we perform immediately. When you complete a Registration you are asked to confirm that you want the service to begin at once and that you acknowledge you will lose your right to cancel once the service has been fully performed. Once the Registration has been recorded on the Register the service has been fully performed and the right to cancel is lost.

6.3

If you cancel before the Registration has been recorded, we will refund the Registration Fee in full within 14 days of being told of your decision, using the same means of payment you used.

6.4

To cancel, tell us clearly before the Registration is recorded, by telephone, through the contact form, or in writing to the registered office. You may use the model cancellation form set out in the Schedule but you do not have to.

6.5

Nothing in this section affects your statutory rights if the service we supply is not carried out with reasonable care and skill.

7. REMOVING OR CORRECTING A RECORD

7.1

You may ask us at any time to correct information recorded about you. We will correct inaccurate information without undue delay.

7.2

We cannot simply delete a Registration on request. The Regulations require records of microchipped cats and dogs to be maintained, and the record serves the statutory purpose of reunification. Where you ask us to erase your personal data we will consider the request under the Privacy Policy and tell you what we can and cannot do, and why.

7.3

Where an Animal has died, tell us and we will mark the record accordingly. We will retain the record for the period set out in the Privacy Policy and then delete or anonymise it.

8. DISCLOSURE OF YOUR DETAILS

8.1

We will disclose recorded details in the circumstances required or permitted by the Regulations. In practice this means we will give the Keeper's name, address and telephone number to an Authorised User who has scanned the Animal or who is otherwise entitled to the information.

8.2

We will not publish your details, we will not sell them, and we will not disclose them for marketing purposes without your consent.

8.3

A member of the public who finds an animal and scans it is not an Authorised User. Where a member of the public contacts us about a found animal we will contact you rather than give your details to them.

8.4

Full detail on how we handle personal data, including the lawful bases on which we rely, is in the Privacy Policy.

9. IF WE CEASE TO OPERATE THE REGISTER

9.1

The Secretary of State may, under regulation 8 of the Microchipping of Cats and Dogs (England) Regulations 2023, require a database operator that does not meet the conditions in regulation 7 to stop holding itself out as meeting them and to provide an electronic copy of the recorded data to the Secretary of State or to another database operator.

9.2

If we cease to operate the Register for any reason, including insolvency, we will use reasonable endeavours to transfer the recorded data to another operator meeting the conditions in regulation 7, and we will notify you of the transfer.

10. OUR LIABILITY TO YOU

10.1

We will perform the Registration service with reasonable care and skill.

10.2

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for any breach of the terms implied by sections 49 and 50 of the Consumer Rights Act 2015, or for any other liability that cannot lawfully be excluded or limited.

10.3

We are not liable for any loss arising from information that you gave us being inaccurate, incomplete or out of date.

10.4

We are not liable for the acts or omissions of any veterinary practice, implanter, breeder, rescue organisation, local authority or other third party.

10.5

Subject to the clause on liability that cannot be excluded, our total liability to you in connection with a Registration is limited to £1,000 for each Animal registered.

11. COMPLAINTS

11.1

If something goes wrong please tell us. Our Complaints Procedure explains how to complain, who will handle it and how long it will take.

11.2

If you are not satisfied with our final response you may refer a data protection complaint to the Information Commissioner's Office at ico.org.uk.

12. GENERAL

12.1

We may transfer our rights and obligations under these terms to another organisation. We will tell you in writing if this happens and we will ensure that the transfer does not affect your rights under the contract.

12.2

This contract is between you and us. No other person has any right to enforce any of its terms.

12.3

Each of the clauses of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect.

12.4

These terms are governed by the law of England and Wales. Section 11 of the Website Terms and Conditions applies to jurisdiction.
